What AI Hallucination Means in Plain Language
When you ask ChatGPT "What are the mandatory returnables for this tender?", it has no idea — because it has not read your tender document. It predicts a statistically plausible answer based on general training data. That prediction is often wrong. This is called hallucination: the AI confidently generates false information.
In a tender submission, a hallucinated requirement, a fake regulation, or an invented project reference — even submitted unknowingly — can lead to immediate disqualification, blacklisting under PFMA, or liability under PRECCA Section 34A (effective 3 April 2024).
What South African Courts Have Already Said
Three South African court cases have already referred lawyers to the Legal Practice Council for submitting AI-generated fake citations:
- Mavundla v MEC (January 2025): A candidate attorney submitted nine case authorities — seven did not exist. Judge Bezuidenhout held that relying on AI without verification is "irresponsible and unprofessional." (SAFLII: [2025] ZAKZPHC 2)
- Northbound Processing v SA Diamond Regulator (June 2025): Junior counsel used an AI tool called "Legal Genius" which produced two fictitious case citations. The court stated that "coherent and plausible outputs are not sufficient if they are false." (SAFLII: [2025] ZAGPJHC 661)
- Parker v Forsyth (2023): The first SA case. The court warned lawyers must not "repeat in parrot fashion the unverified research of a chatbot."
⚠️ The legal risk: When you submit a tender, you sign a legal declaration that all information is true and complete. An AI-generated false statement — even unknowingly — can trigger PRECCA prosecution and listing on the Register for Tender Defaulters.
Why Generic AI Cannot Help With South African Tenders
ChatGPT / Gemini / Grok
- No knowledge of your specific tender document
- No knowledge of your B-BBEE level or compliance status
- No awareness of PFMA, MFMA, or B-BBEE scoring rules
- Cannot check if your certificates are valid or expired
- Generates plausible-sounding but potentially false outputs
- No audit trail for PFMA compliance
Tender Aid
- Reads your actual uploaded tender document
- Knows your organisation profile and compliance status
- Built around PFMA, MFMA, and B-BBEE requirements
- Compliance Vault tracks all certificate expiry dates
- Every output sourced to a page in your document
- Immutable audit trail for forensic review
💡 The distinction that matters: Tender Aid is not anti-AI — it is pro-verified AI. Every extracted requirement is sourced to the actual tender document. Every uncertain output is flagged for human review. You get the speed of AI without the legal risk.
